A small number of two specific types of implantable cardioverter defibrillator may be prone to battery depletion, according to Medtronic, the device's manufacturer. On February 11, 2005, Medtronic Inc. issued a statement to physicians advising them that over 80,000 implantable cardioverter-defibrillators (ICDs) and cardiac resynchronization therapy defibrillators (CRT-Ds) are prone to battery depletion and failure. The battery shorting mechanism could cause the battery in these defibrillators to experience a rapid depletion of power resulting in the loss of device function.

The devices in question include the Marquis VR/DR and Maximo VR/DR ICDs and the InSync I/II/III Marquis and InSync III Protect CRT-D lines. They were manufactured between April 2001 and December 2003.

When a medical device, such as a Medtronic pacemaker injures someone, courts must determine whether there was something wrong with the product. In finding the answer, two general theories of liability are applied to analyze the facts surrounding the injury: products liability (sometimes referred to as strict products liability) and negligence.

The basic difference is that products liability focuses primarily on the medical device itself, while negligence focuses on the manufacturer, seller or distributor's conduct as well as the product. Both theories look at what was wrong or defective in the medical device. An experienced attorney will be able to guide you through this process and get you the compensation that you deserve in your Medtronic Pacemaker Lawsuit.
